Terms of service

Draft — not yet reviewed by counsel. This text describes how Holiday Registry actually behaves and is written to meet FTC, Amazon Associates, COPPA, and CAN-SPAM obligations, but it must be reviewed by a lawyer before the site opens to the public.

Using Holiday Registry

Holiday Registry is a free service for coordinating gifts within a family. You need to be 13 or older to hold an account. Keep your sign-in details to yourself, and tell us if you think someone else has got into your account.

Families and managed profiles

A family head can invite and remove members, create profiles for children, and decide who manages those profiles. A family always has at least one head.

If you create a managed profile for a child, you are confirming that you are their parent or guardian, or that you have that person’s permission. If you promote a managed profile to a full account, you are confirming that the person is at least 13 years old. We record that confirmation and the time you made it.

What you put on your list

Your items and links are yours. Do not add anything unlawful, and do not use the service to send unwanted email — invitations are rate limited and abuse will end your account.

Links and commissions

Links you add may be converted into affiliate links when someone clicks them, and any affiliate parameters already in a link may be replaced with ours. We keep your original link unchanged and apply this only at the moment of the click. You pay nothing extra and the price does not change. Full detail is in our affiliate disclosure.

What we do not do

We do not take payments, hold money, or move money between people. Claiming a gift is a note to your family that you intend to buy it — it is not a purchase and it is not a contract with anyone.

We are not the shop. What you buy, whether it arrives, and what happens if it does not are between you and the retailer.

Surprises

We build the service so a list owner cannot be shown claims on their own list, and we take that seriously. We cannot promise a family member will not tell them, and we cannot promise a service free of every possible defect.

Ending it

You can delete your account whenever you like. We can suspend an account that is being used abusively. If we close the service, we will give you notice and a way to take your lists with you.

The legal part

The service is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss — including, and we say this without much of a straight face, a spoiled surprise.
